The 4th U.S. Circuit Court of Appeals upheld the dismissal of an employee’s failure-to-accommodate claim against her employer for refusing to split a full-time position into two part-time positions.
The plaintiff worked as a pharmaceutical representative for Sanofi-Aventis U.S. LLC (Sanofi) in South Carolina. She usually called eight physicians a day and attended medical education programs, often at night or over the weekend. She traveled during more than 50 percent of her work time.
