ERISA ‘Excessive Fees’ Claim
On Dec. 6, the Supreme Court heard arguments in an employee benefits case, Hughes v. Northwestern University, which was brought by participants in a defined contribution retirement plan. The participants claim they were charged excessive fees and that plan fiduciaries breached their duty of prudence under the Employee Retirement Income Security Act (ERISA).
